Consent Policy
Consent is not a checkbox on WiHire.ai. It is the architecture. This policy explains precisely how your consent is collected, stored, enforced, and honoured — and what it means in practice.
1. What Consent Means on This Platform
On WiHire.ai, consent is not a one-time acceptance at registration. It is a per-action, per-match, individually revocable decision that you make each time your data moves. The following distinct consent events exist:
- Platform consent (registration): you agree to be anonymously matched by AI against available roles. No identity is disclosed at this stage.
- Match consent: for each specific match, you individually decide — with full information about the role — whether to reveal your identity and resume to that specific recruiter, for that specific role only
- Resume generation consent: you authorise Zeyla™ to generate a tailored resume for a specific role before it is made available for access
- Ongoing right to withdraw: you may withdraw consent for any individual match at any time, without penalty and without affecting other matches
This architecture is the subject of pending U.S. Patent Application 64/033,113.
2. How Consent Works — Step by Step
3. Recruiter Permissions and Restrictions
Recruiters may:
- View anonymised AI match scores for any candidate matched to their posted role — at no charge
- Access a candidate's full profile and resume after the candidate has granted explicit consent for that specific role
- Contact a consented candidate through the platform's designated communication channels
Recruiters may not:
- Access any candidate's identity, name, resume, or contact information without that candidate's per-match consent
- Use candidate data for any role other than the one for which consent was granted
- Share, transfer, sublicense, or sell candidate data to any third party under any circumstance
- Attempt to re-access or retain candidate data after consent has been withdrawn
- Attempt to identify, de-anonymise, or contact any anonymous candidate outside the Platform's consented channels
- Use any candidate data for immigration-related processes of any kind
Violation of these restrictions constitutes a material breach of our Terms of Use and may result in immediate account termination, civil liability, and referral to relevant authorities.
4. The Consent Audit Record
Every consent action on WiHire.ai is recorded in a write-protected, append-only audit record. Each entry contains:
- A unique transaction identifier
- The action taken (consent granted / withdrawn / resume accessed / match declined)
- The UTC timestamp of the action
- The specific match or role involved
- Anonymised identifiers for the parties involved
These records are maintained in a write-protected format and are retained for seven (7) years for legal compliance purposes. You may request a copy of your consent audit record at any time by emailing hello@wihire.ai with the subject "Audit Log Request."
Note: Because these records serve as legal evidence of consent decisions and regulatory compliance, they are not subject to deletion requests to the extent required by applicable law. The records do not contain your resume or profile content — only the metadata of consent decisions.
5. Zeyla™ and Consent Boundaries
Zeyla™ is WiHire's AI guide. Her role in the consent architecture is strictly defined:
- Zeyla does not share your data with any recruiter — she facilitates your decision, she does not make it
- Zeyla generates tailored resume content only for matches to which you have affirmatively consented
- Zeyla answers questions about your matches, platform features, and consent options — she does not retain conversation content beyond the active session
- Zeyla's outputs — including match explanations, gap analysis, and resume content — are AI-generated and probabilistic in nature. They may contain errors. Always review Zeyla's suggestions before acting on them. Final career and employment decisions are yours alone
6. Consent and Applicable Law
WiHire.ai's consent architecture is designed to meet or exceed the requirements of major data protection frameworks. However, legal requirements vary by jurisdiction and you remain responsible for understanding your rights:
- GDPR and UK GDPR (EU/UK): consent is freely given (not conditioned on access to unrelated services), specific (per-match), informed (full role information provided), and unambiguous (affirmative action required). Withdrawal is as easy to exercise as granting. Audit records are retained under the lawful basis of legal obligation, not consent. EU/UK users have the right to lodge a complaint with their local data protection supervisory authority if they believe their rights have been violated.
- CCPA/CPRA (California): we do not sell personal data. You have the right to know what data we hold, to request deletion, and to opt out of AI-based profiling. We do not discriminate against users who exercise these rights.
- PIPEDA (Canada): consent is obtained before or at the time of collection. Withdrawal is honoured within a commercially reasonable time, not to exceed seventy-two (72) hours.
- Other jurisdictions: users in other jurisdictions should consult applicable local law. Contact hello@wihire.ai to enquire about specific jurisdictional rights.
7. Employment Law Compliance — AI Hiring
EEOC and EEO Statutes
The consent architecture governs when your data is shared — it does not eliminate employment discrimination risk. Title VII, the ADEA, the ADA, and the Equal Pay Act apply to any AI-based selection procedure, including WiHire's match scoring. Recruiters who use AI match scores in ways that produce disparate impact on protected classes remain fully liable under applicable EEO law regardless of candidate consent to data sharing.
UGESP — AI Not Independently Validated
The Uniform Guidelines on Employee Selection Procedures (41 CFR Part 60-3) require that selection procedures producing adverse impact be validated for job-relatedness. WiHire.ai's six-dimension scoring model has not been independently validated against job performance outcomes. This is disclosed in the interest of full transparency. Recruiters must not use AI scores as a sole or primary exclusionary criterion.
Colorado Artificial Intelligence Act (SB 24-205)
Colorado law classifies AI systems used in employment decisions as high-risk. In addition to the consent rights described in this policy, Colorado residents have the following rights under SB 24-205:
- Right to explanation: request an explanation of how the AI match score affecting you was generated
- Right to correct data: request correction of any inaccurate data used in the AI decision
- Right to appeal: appeal any AI-based match or exclusion decision
- Right to human review: request that a human, rather than AI alone, assess your profile for a specific role

Right to File a Regulatory Complaint
Consent to data sharing under this policy does not waive any right you have under employment or civil rights law. You may file complaints with:
- EEOC — www.eeoc.gov — for employment discrimination claims
- U.S. Department of Labor — www.dol.gov — for wage, labor standards, and OFCCP matters
- Your state's civil rights or labor agency — for state-law employment discrimination or privacy claims
- Your data protection supervisory authority (EU/UK users) — for GDPR/UK GDPR complaints
Anti-Retaliation
PIXONIQ LLC prohibits any use of this platform to retaliate against a candidate for filing, expressing intent to file, or participating in any EEO complaint, labor charge, or regulatory proceeding. Any recruiter found to have engaged in retaliatory conduct will have their account immediately terminated and the matter referred to the EEOC or relevant authority.
8. Patent and Intellectual Property
The consent-gated AI agent architecture described in this policy — including the method by which AI agents match, score, and disclose candidate data exclusively upon verified, per-match human consent — is the intellectual property of PIXONIQ LLC and is the subject of pending U.S. Patent Application 64/033,113. Imitation, commercial reproduction, or deployment of substantially similar systems without written authorisation from PIXONIQ LLC is strictly prohibited and may result in legal action.
